Donald Trump has declared war against Antifa. It’s a battle he’ll have trouble winning, as Antifa doesn’t exist. But wait, you’re probably saying, I hear about Antifa all the time on the news! You do, but it’s a general term claimed by all manner of protesters against fascist ideologies rather than an actual organization with leaders, membership, a headquarters, and so on.
But for Trump and his goons, Antifa not existing is actually a plus point, as they can point to whatever they like, say “that’s Antifa” and there’s nobody to contradict them. Case in point, an ongoing Texas prosecution against anti-ICE protestors that the Trump administration insists are an “Antifa cell”.
Their trial began on Tuesday and ended mere hours later in bizarre circumstances when Trump-appointed district judge Mark Pittman ruled that one of the defense attorneys’ t-shirts was likely to influence the jury.
The t-shirt was worn by attorney MarQuetta Clayton and featured an image of Martin Luther King Jr, along with other civil rights leaders. Clayton reportedly had the shirt on under a black blazer and the judge hadn’t commented on it until she began questioning the potential jurors.
“I don’t think I have any choice”
Pittman immediately stopped the trial and argued that the shirt sent a political message that he believed would nudge jurors to equate the defendants with the civil rights movement, saying he believed this was Clayton’s intention when she wore it. He also insisted he’d have applied the same standards if a prosecutor had worn a pro-Trump shirt in front of a jury. As he said:
“I don’t think I have any choice but to declare a mistrial. This has to be a first in the history of American jurisprudence, I would think.”
The jurors were dismissed and the case was adjourned to next Monday, where it will begin again with an entirely new panel of jurors.
The defense lawyers argued that there was no evidence any juror had even seen Clayton’s shirt, which she was wearing under a blazer. Additionally, any juror bias would be identified during selection. Prosecutor Shawn Smith didn’t have an opinion, though he said he’d never encountered a situation like this.
One thing’s for sure, the Trump administration wants these nine defendants nailed to the wall and they’re going to pull out all the stops to do it. They want to make an example of them as scare tactics to show anyone daring to oppose ICE that they will face lengthy prison sentences, regardless of whether anyone was injured during the demonstration.
The trial will begin (again) on Feb 23, 2026.
