“Something has surely failed.”

Footage has captured a horrible true crime story. The heartbreaking moment Andre Roche Ceron, 48, walked to a public fountain to wash blood from his hands and arms after allegedly stabbing his ex-girlfriend, Kimberli Durán García, 33, to death. The incident took place in the middle of a park in Figueres, a town in Girona, Spain, where the victim was then left to die in the street.

The suspected killer appeared to act with a complete lack of concern as he cleaned himself in broad daylight. According to The Sun, the video captures a witness shouting, “I don’t know who he is but he’s escaping”, while the suspect was at the fountain. 

The situation then escalated quickly when a group of locals, including an off-duty police officer, confronted the man. He was seen fighting back while shirtless in a children’s play area before the group managed to pin him down. He was arrested shortly after this confrontation.

While the crime is horrendous, every moment leading up to it is worse

On Monday, Roche Ceron had been issued a restraining order for mistreating Kimberli, but he violated the order just hours later. Although he was initially arrested for the breach, he was released on bail the next morning. Just six hours later, Kimberli was killed.

According to local accounts, the suspect tracked the victim to Josep Tarradellas Square, where he allegedly used a knife to stab her multiple times. Emergency responders arrived at the scene, but they were unable to save her.

The High Court of Justice of Catalonia explained that a fast-track trial had taken place on Monday, May 18. During that proceeding, the suspect admitted to a crime of mistreatment and accepted a six-month suspended prison sentence. The agreement also included a restraining order prohibiting him from communicating with the victim or coming within 250 meters of her for one year and four months.

Unfortunately, after Monday’s order violation, Kimberli did not attend a forensic appointment to assess her injuries. That and her testimony were necessary to keep the suspect in custody. It remains unclear why she did not appear for the appointment.

Figueres mayor Jordi Masquef expressed frustration regarding the outcome of the case. He stated, “something has surely failed”. He added, “I wish we did not have to learn from situations like this because we should not have to mourn the loss of a human life.” 

He went on to say, “From the Town Council we can only condemn this sexist crime and, above all, as mayor, what I must do is offer condolences to the family and try to ensure that incidents like this, episodes like this, scourges like sexist violence are never repeated again either in our town or anywhere else.”

As the case is processed going forward, it has raised serious questions regarding the legal protections for victims of domestic abuse. Honestly, this is a conversation that needs to happen around the world, especially as women lose their rights in today’s America, and in some cases, we see violence go both ways.
