‘Attention was divided’: TikTok influencer’s husband faced child abuse allegations after son’s drowning during sports bet

The investigation into the drowning death of TikTok Influencer’s three-year-old Trigg Kiser has ended, with a police report showing that the boy’s father, Brady Kiser, was distracted by a sports bet when the accident happened. The Chandler Police Department suggested a felony charge against the father, but prosecutors later decided not to file charges.

The police report concluded that Brady Kiser’s attention was heavily divided and that he was not actively watching his son during this critical time. The document noted that the father did not know what his son was doing just before he fell into the water and did not see the boy struggling. The report stated that the tragedy happened because the child was left unsupervised near an unsecured pool and did not know how to swim. Home surveillance footage showed that Trigg did not go into the water on purpose but instead tripped and fell in while playing with an inflatable chair.

The police report, obtained by Fox, was released after the investigation closed on July 15, 2025. It described the final moments of the young boy, who was the son of well-known TikTok influencer Emilie Kiser. The incident took place on May 12, 2025, at the family’s home in Chandler, Arizona. According to the report, the boy’s father, Brady Kiser, was watching the couple’s three children while Emilie Kiser was out having dinner with friends.

TikTok influencer’s child dies while father’s attention was elsewhere

A key part of the investigation focused on what Brady Kiser was doing right before the tragedy. The police report said he had placed a $25 bet on a basketball game, wagering that Boston Celtics star Jayson Tatum would score more than 40 points in a game against the New York Knicks. He placed this bet around 5:15 PM. Later, just before 6:30 PM, around the same time the basketball game started, Trigg Kiser began playing in the backyard.

The report states that about three minutes after the game began, the boy accidentally tripped and fell into the family’s unsecured swimming pool. He stayed in the water for seven minutes.

When Brady Kiser found his son unconscious in the pool, he called for help. Police and paramedics arrived and immediately performed CPR to try to save the child. The boy was taken to a hospital, where he stayed for six days before passing away. During interviews with investigators, the father gave conflicting statements about how long the child had been unsupervised, at one point saying three minutes and later saying five minutes.

After the investigation, the Chandler Police Department recommended a class 4 felony charge of child abuse against Brady Kiser. However, the Maricopa County Attorney’s Office chose not to move forward with charges. Their decision was based on the legal standard needed for a conviction. The office explained that to prove child abuse, the state must show, beyond any reasonable doubt and with a unanimous jury, that the person failed to recognize a serious and unreasonable risk and that this failure was a major departure from how a reasonable person would act.

After carefully reviewing the evidence from the police, the Maricopa County Attorney’s Office decided the case did not meet this high standard for a likely conviction. The review process involved multiple attorneys, senior legal experts, and the County Attorney herself.
