The Utah Supreme Court’s redistricting case took an unexpected turn after the ex-husband of Diana Hagen revealed an affair that forced her to resign from her post.
As far back as 2018, Utah has been going through a major state court challenge to change Utah’s congressional maps — with the state’s civil rights group making the argument that these are partisan gerrymanders. Slow progress was being made until 2020, when the Republican-led legislature split Democratic Salt Lake County to be absorbed into 4 neighboring counties and effectively weakened the opposition in mid-terms.
These are tactics that have since been embraced by President Donald Trump and even increasingly grown in favor in Democratic dominated states. As of Feb. 2026, a federal three judge panel rejected the court-ordered congressional map that was proposed by the Utah Republicans. And that’s when the story moved from politics to personal.
According to Daily Mail, Tobin Haget filed a complaint last year with the Judicial Conduct Commission alleging that his ex wife was having an affair with David Reymann. Initially, Reymann and Diana denied any notion that the two were having a romantic affair. Then Republican lawmakers, including Senate President J Stuart Adams and House Speaker Mike Schultz, demanded the affair to be investigated. It didn’t take long before Hagen resigned and alluded that Reyman might have been the cause of the dissolution of her marriage.
Hagen then released a statement in part saying, “As a public servant for twenty-six years, I am keenly aware that public service requires sacrifice. I have willingly accepted those sacrifices for the privilege of holding a position of public trust, where I could do my part to uphold the rule of law and protect the rights of every Utahn.”
Reymann was one of the lawyers who was challenging the redistricting map before the Supreme Court that retained the newly formed four Republican-districted seats in Utah. Hagen and her husband had separated in early 2025, during the height of the case. After Hagen recused herself she announced that she had recently “renewed her friendship” with Reymann.
Utah Governor Spencer Cox released a statement that read: ‘Today, Gov. Cox received a letter of resignation from Utah Supreme Court Justice Diana Hagen. The resignation is effective immediately. The governor appreciates Justice Hagen’s years of service to the state of Utah.”
Tobin’s complaint last year alleged that his ex-wife and Reymann’s relationship initially started as “silly” texts but as time went on, their communication turned “more suggestive.” Now that his ex-wife has stepped down from her job — Diana has asked for a return of privacy to her friends and family, saying that they didn’t choose to have a “public life.”
Life in public office always has its hard to miss benefits but it certainly has its fair share of drawbacks too. A judge’s life probably has taken a career defining dip because she made a mistake that her detractors believe might have affected her judgement. Now a 35 year marriage is over too. Reportedly, Adams and Schultz were not interested in making her life even harder — so they have since dropped their lawsuit.
