‘Uber tried suing me’: Delivery driver sues man after falling while bringing his food but man has video evidence proving he’s not at fault

The Uber driver ignored multiple warnings from the man.

Ordering food through Uber can often be convenient for people too busy to cook for themselves. However, one man on TikTok may have got the worst deal ever when his food delivery resulted in him being sued by the driver, despite the fact he tried to save them.

TikToker Michael Jr. posted a clip asking for legal advice earlier this week and it has since gone viral garnering over 2 million views and almost 200,000 likes. TikTok is a surprisingly good place to go for legal disputes. In what appears to be security footage outside of his home, we can hear Michael calling out to the delivery driver who has just arrived.

He can be heard saying, “don’t walk through there, that’s not grass” referring to a part of the sidewalk that appears to be grass. It turns out that the grass is actually covering a deep ditch; talk about poor city planning. Anyways, despite Michael repeatedly and very clearly warning his delivery driver of the hazard, he is ignored and the man carrying his food walks straight into the ditch in what looks to be quite a painful fall.

The Uber driver allegedly tried to sue

In the video’s caption Michael explains that the driver “tried to file a claim to sue me for damages,” he also asks, “Do you think he has a case?” Regardless of whether the man was injured or not, it’s difficult to see how this would be Michael’s fault, first of all, the responsibility for the sidewalk is surely with the city, not the guy whose house it is outside of. Secondly, the footage clearly shows Michael doing everything he can to clearly and concisely warn the Uber driver not to step on the grass.

In the comments people almost unanimously agreed that it was not Michael’s fault. Most poked fun at the man for not listening to Michael in the first place, comparing it to another classic viral video

This is clearly not a place someone could walk

In an update video Michael also shows that it’s quite clear that people aren’t supposed to walk through the grass showing another delivery driver who is a little more observant walking around the hazard.

According to him the ditch is what he refers to as a “bio-retention pond.” There appear to be low fences around them and in the second video it seems clear that this is not a patch of ground one could step on. 

Ultimately it seems like that one driver may just have to accept they were in the wrong in this situation. The hole in the ground seems pretty obvious to most and on top of the Michael gave plenty of warning. They just need to be more observant in future.
