A New York woman says she did what safety experts encourage drivers to do when a medical emergency made it unsafe to continue behind the wheel. Instead of preventing a crash, she claims the decision led to a lengthy impaired driving investigation, an incorrect police report, and a pending driver’s license suspension.
The account, shared by Reddit user Short-Mongoose5641 in the r/LegalAdvice subreddit in July 2026, has attracted thousands of reactions as commenters debated drivers’ rights during medical emergencies. So far, all we have to go on is the Redditor’s account of what allegedly happened as no New York law enforcement agency has publicly commented on the allegations.
According to Short-Mongoose5641, the incident occurred several weeks ago while she was driving home late at night on unfamiliar roads. She wrote that bright headlights from oncoming traffic triggered a sudden, severe migraine. Rather than continue driving, she pulled into a well-lit area so a passenger could take over.
The driver became overwhelmed by the pain
The Reddit user then says the migraine became so intense that she vomited shortly after stopping. Separate incidents have shown car exhaust can trigger migraines.
During that time, a police officer approached the vehicle. She explained that she was experiencing a migraine and planned to switch drivers. The poster said they were asked to exit the vehicle and take a breath test.
They wrote that they registered 0.00% blood alcohol content but still underwent field sobriety testing before officers detained her for evaluation by a Drug Recognition Expert. “I was read my Miranda rights, blew 0.00% a second time, and was subjected to hours of testing,” Short-Mongoose5641 wrote.
The user said some of the examinations involved bright lights in a dark room, which she claimed intensified the migraine and caused her to vomit repeatedly. According to the post, investigators ultimately determined they were sober and released them without issuing any criminal charges or traffic citations shortly before 4 a.m.
The situation, the Reddit user alleged, did not end there. She later allegedly received a notice from the New York State Department of Motor Vehicles stating that their driver’s license would be suspended pending a physician’s evaluation.
According to the notice described in the post, the stated reason was a “motor vehicle crash where I lost consciousness.” The Reddit user disputed that description, writing, “There was no crash, no damage, no injuries, and I never lost consciousness.”

The post also claimed she obtained a copy of the police report. They described numerous inaccuracies involving the timeline and events surrounding the encounter.
In an update, Short-Mongoose5641 said she photographed and recorded her vehicle to document what she described as the absence of crash damage. She also said she had begun contacting attorneys but found that several lawyers declined to take the matter because no criminal charges had been filed.
The poster added that a DMV representative told her the only available path involved submitting paperwork completed by a neurologist. She wrote that obtaining an initial neurology appointment could take six months or longer, while their primary care physician reportedly declined to complete the required paperwork without a specialist’s evaluation.
She also said she planned to seek body camera footage as she believes it would contradict the written police report.
