Woman waits for her order from Lululemon. FedEx allegedly claims it was delivered, with one questionable proof of delivery: ‘Do we file a police report?’

The pains of modern delivery.

Package deliveries usually come with a hit of dopamine, mostly because you anticipate it. So, a failed or damaged delivery can be pretty frustrating. Now what if it comes with really questionable proof? This was one of the questions Heather Ohman had for her viewers after her daughter’s Lululemon delivery through FedEx was a no-show. Her resulting video, as she posed her questions to Instagram, got her more than 484K views in just three days.

“My daughter ordered a big package from Lululemon, like seven or eight items in it,” she told her viewers. Ohman noted that the delivery notification came in the afternoon, but the “proof of delivery” photo didn’t actually provide any proof. She attached a screenshot and pointed out, “There’s no package, no porch, no front door, nothing that even identifies our house. It’s just the shadow of a delivery driver who actually looks like he’s still holding a box.”

Ohman reviewed her home security footage and claimed FedEx never came by. The only delivery that the cameras recorded was from Amazon at 8:00 AM. Ohman’s alleged that she had to call FedEx over three times to get a response. The company purportedly told them, “There’s nothing that they can do, and to call Lululemon.” Lululemon allegedly first asked her to wait 24 hours. Then she was told, “We’ll contact you in a couple of days when we decide what we’re going to do”  

The entity responsible

The post details Ohman’s claim, which can’t be verified. However, it tracks with Lululemon’s policies. They require customers to wait 24 hours after a package is marked as delivered before they can submit a claim for missing items. According to the site, once that window has passed, customers can use their self-serve portal to report the issue. From there, the company reviews the claim and provides updates within two to three business days. 

Ohman and her daughter having to wait sparked a genuine question. She asked, “So, Internet, who’s responsible for figuring out where this package went? Is it FedEx? Is it Lululemon? Or is it somehow us?

Instagram came through with a lot of disdain for FedEx. One user commented, “FedEx should be responsible, but don’t hold your breath to get any response!!” Another user suggested, “100% fed ex needs to find it. Can fedex look up a geo location for that pic? That should tell you all about that d****ss proof of delivery pic.” Recently, FedEx went viral on Instagram for allegedly destroying a batik painting. However, in this instance, there was no proof.

Some users were even more cynical about the courier service. As one user wrote, “Allegedly fed ex steals packages as a rule. It’s allegedly a real thing. You’re never going to get that package. Sorry.” However, quite a few told Ohman that it’s on Lululemon. One noted, “Ultimately Lululemon should help you escalate this with fedex, they are the shipper and ultimately the one who arranged shipping with fedex.”

According to Return Prime, U.S. law provides certain protections for buyers, such as the right to timely delivery. When an item is damaged or missing, federal and state laws generally dictate that the seller is responsible for resolving the issue, even if the error occurred during transit. As noted by Return Prime, “If an item shows up damaged, the seller is responsible, even if the damage happened during shipping.” 

Shortly after her initial post, Ohman provided an update. She claimed, “Lululemon came through. They are replacing the entire order and shipping it again. So technically, we’re being made whole.” However, since the original package remained missing, Ohman had concerns about the driver’s actions and the potential for future issues. She asked her audience, “Do we file a police report? Or do we just take the replacement and let it go?”

The reactions to her update were split. One user pointed out the broader impact of such incidents, stating, “You have to report…not only is it a crime, but retailers and consumers are also affected. This is why the luxury brands are so expensive.” However, many told her to just let it be.
