Marjorie Taylor Greene asks Trump to ‘prosecute Fauci’ after he announces Biden’s Autopen pardons void

Marjorie Taylor Greene has renewed her attack against Dr. Anthony Fauci after Trump deemed all Biden-era pardons invalid. She immediately called for Fauci’s prosecution, fueling the controversy surrounding his COVID-era actions again.

Dr. Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases, has been under scrutiny since the COVID-19 pandemic. Republican politicians and critics have long accused him of misleading the public about the origins of the virus. They also claim that Fauci mishandled the pandemic by promoting social, economic, and mentally harming measures.

However, no widely accepted conviction or consensus has been confirmed to date, which would prove Fauci’s crime. Yet, most Republicans accuse him of having committed “crimes against humanity.” Marjorie Taylor Greene was one of Fauci’s harshest critics during the initial blow-up of the case. And if his pardon is canceled, she again has room to corner him.

Greene called for Fauci to be put in prison in 2024

During a June 2024 congressional hearing of the Select Subcommittee on the Coronavirus Pandemic, Greene refused to use the “Dr.” prefix for Fauci. She accused him of practicing “repulsive evil science” and called for his license to be revoked. It was the first time Fauci had testified publicly, but Greene verbally attacked him during the entire hearing.

“Prison. That’s where Anthony Fauci belongs. Not sitting in a committee hearing, lying to our faces. Mr. Fauci should be prosecuted and thrown in jail,” Greene posted on X after the hearing.

Her verbal attacks continued despite Fauci testifying that comments like those from Greene have triggered death threats against him and his family. Robert Garcia, a Democratic congressman from California, even admitted, “This might be the most insane hearing I’ve actually attended.”

Biden issued a pardon to Fauci before leaving office

On Jan. 20, 2025, outgoing President Joe Biden issued a preemptive pardon to Fauci and several others, including members of the Jan. 6 committee. Expressing his appreciation, Fauci added that the pardon is simply a protective measure against threats to him and his family. He maintained his innocence, saying,

“I have committed no crime, and there are no possible grounds for any allegation or threat of criminal investigation or prosecution of me.” (via TOI)

Biden also issued a statement to back Fauci’s claim. “The issuance of these pardons should not be mistaken as an acknowledgment that any individual engaged in any wrongdoing, nor should acceptance be misconstrued as an admission of guilt for any offense,” the statement read. (via kbps)

Trump has challenged Biden’s last-minute pardons

After Trump assumed office, he has alleged that most of Biden-era executive orders were signed by an autopen, and not the president. He claims that Biden did not authorize his last-minute pardons, and they were carried out by his aides at their discretion, illegally.

While Trump has been firm in his allegation since the beginning of his term, he could not prove them legally. But on Nov. 28, he suddenly announced on his Truth Social that he is cancelling all orders signed by the autopen during Biden’s administration.

“Any document signed by Sleepy Joe Biden with the Autopen, which was approximately 92% of them, is hereby terminated, and of no further force or effect.”

This prompted Greene to immediately ask for the prosecution of Fauci again. “If Autopen Pardons are repealed, then prosecute Fauci for crimes against humanity,” she wrote on X.

Can Dr. Fauci be prosecuted?

Biden’s pardon protected Fauci against federal prosecution for any crimes committed before the pardon. This includes preemption from politically motivated investigations into his pandemic-era actions. And it is still debated whether Trump has the legal authority to reverse Biden’s pardons because of the autopen.

So, Trump’s claim of “terminating” all of Biden’s executive orders, especially pardons, stands baseless. An 1869 ruling of a federal court clearly states that “when a pardon is complete, there is no power to revoke it.” And if Fauci’s pardon cannot be revoked, then he cannot be prosecuted.
